Terms of Service

1. Acceptance

By creating an account or using GiftCycles (“the Service”), you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. Description of service

GiftCycles is a gift-registry platform that enables parents and guardians (“Parents”) to create occasion-based giftlists for their children and share them with family and friends (“Gifters”). Gifters can browse giftlists and claim gifts without needing an account.

3. Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account with others.
• We reserve the right to suspend accounts that violate these terms.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Post false, misleading, or fraudulent giftlist items.
• Attempt to access other users’ accounts without authorisation.
• Use automated tools to scrape or abuse the Service.
• Impersonate another person or entity.

5. Gift claims

When a Gifter claims a gift, they make a non-binding commitment to purchase that item. GiftCycles does not process payments and is not responsible for any transactions between Parents and Gifters. Claim identities are revealed to the Parent after a configurable anonymity period (default: 30 days after the occasion).

6. Affiliate links & Amazon Associates

GiftCycles is a participant in the Amazon Associates Programme, an affiliate advertising programme designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.

Some purchase links displayed on the Service are affiliate links. When you click an affiliate link and make a purchase, GiftCycles may earn a small commission. This commission is paid by the retailer and comes at no extra cost to you — the price you pay is the same whether or not you use our link.

• GiftCycles does not control the pricing, availability, or content of third-party retailer sites.
• We are not responsible for purchases made through affiliate links.
• Affiliate commissions help us keep the Service free for families.

7. Intellectual property

All content you upload (gift names, descriptions, images) remains yours. By uploading content, you grant GiftCycles a non-exclusive licence to display it within the Service for the purpose of providing the Service.

8. Disclaimer of warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the maximum extent permitted by law, GiftCycles shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Organizations

GiftCycles for Organizations extends the Service to verified children’s charities (“Organizations”) coordinating gift drives and facility needs with donors (“Donors”). This section applies in addition to the rest of these Terms wherever an Organization account is used.

• Verification. An Organization must provide accurate registration/charity details and may not publish a public list until we’ve verified them. Providing false verification information is grounds for immediate suspension.
• Safeguarding responsibilities. An Organization is responsible for ensuring child profiles and list content contain no identifying information about the children in its care — no real names, photos, school names, or medical details. Publishing a list requires an explicit confirmation of this before it goes live.
• Right to suspend. We may unpublish a specific list, or suspend an Organization’s entire account, at any time if we reasonably believe it violates these Terms or poses a safeguarding risk — including automatically, as a precaution, if a list receives multiple independent concern reports in a short window. Suspension is reviewable; contact hello@giftcycles.com to appeal.
• Audit logging. Actions taken within an Organization’s account that affect safeguarding — publishing a list, team membership changes, child-profile edits — are recorded in an audit log available to that Organization’s owner and admins, and retained for 12 months.
• Deletion. An Organization owner may delete the Organization account at any time. Doing so permanently deletes all child profiles, archives and unpublishes all lists, and takes the Organization offline; see the Privacy Policy’s Organizations section for full detail.

11. Termination

You may delete your account at any time by contacting support@giftcycles.com. We may suspend or terminate accounts that violate these terms without notice.

12. Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
